    The Department for the Economy (the Department) has accepted disqualification undertakings from the directors of a soft drinks wholesale business.

    Undertakings were received for seven years each from Hugh Francis Daly (48) of Haypark Avenue, Belfast, Co Antrim and from Kevin Daly (43) of Carran Road, Crossmaglen, Co Armagh in respect of their conduct as directors of Carndale Enterprises Limited.

    The Company operated in the wholesale of soft drinks and went into liquidation on 2 February 2017 with an estimated deficiency as regards creditors of £2,552,691.

    The Department accepted the disqualification undertakings from Hugh Francis Daly and Kevin Daly on 8 January 2021 based on the following unfit conduct which solely for the purposes of the disqualification procedure was not disputed:

    • causing and permitting the company to breach the Companies Act 2006 by filing dormant accounts during periods when they knew or ought to have known that the company was trading. Furthermore they caused and permitted the company to produce accounts which did not comply with Financial Reporting Standards; and
    • they caused and permitted the company to fail to file accurate VAT returns during periods when they knew or ought to have known that the returns were materially incorrect.

    The Department has accepted fourteen Disqualification Undertakings in the financial year commencing 1 April 2020.
