Priority Dispatch under the Renewable Energy Directive

Summary

The Department proposes that it should make regulations under section 2(2) of the European Communities Act 1972 which would give the Department of Enterprise, Trade and Investment, or the Authority with the consent of the Department, the power to make modifications to the conditions of licences, codes, etc, in such a way as to ensure compliance with Article 16(2)(c) of the Renewable Energy Directive and Article 8(1) of the Cogeneration Directive.

Consultation description

The Department has taken the view that the requirement in Article 16(2)(c) for priority dispatch to be based on transparent and nondiscriminatory criteria does not need to be expressly addressed in legislation. The Department believes that this requirement can be addressed in the drafting of the relevant new or modified licence conditions which would remain subject to the requirements of the Directive. NIAUR may also need to consult on the modifications it proposes to make under the regulations when they come into
effect.
