Miscarriage Leave and Pay

The Minister for the Economy has launched a consultation on the proposal to change the entitlement criteria for Statutory Parental Bereavement Pay to make it a “day one” right by removing the eligibility requirement for 26 weeks of continuous employment, and to also introduce Miscarriage Leave and Pay as an amendment to the existing policy of Parental Bereavement Leave and Pay. This consultation document sets out the policy position of the department and seeks views on those proposals.


Consultation description


This consultation seeks to inform the public about the government’s intention to introduce Miscarriage Leave and Pay entitlements into Northern Ireland employment law akin to the Parental Bereavement Leave and Pay entitlements that came into force in Northern Ireland on 6 April 2022.

It is intended that these rights will be a day one entitlement. This means that there will be no qualifying period before an eligible worker or employee can avail of parental bereavement leave and/or pay following a miscarriage.

Northern Ireland will be the first region of the United Kingdom to place such miscarriage protections and entitlements for workers and employees on a statutory footing, and one of the first countries in the world to do so.
