    This memo provides guidance to projects around eligibility evidence for EU citizens remaining in the UK

    Dear Project Promoter,

    Following the UK’s withdrawal from the European Union, and the end of the transition period, freedom of movement ended at 11pm on 31 December 2020.

    From 1 July 2021 only UK and Irish passports or birth certificates will be accepted to confirm the participants’ eligibility criteria of the right to live and work in the UK. All other EU passports cannot be accepted.

    In future where no other evidence of right to live and work in the UK is presented, that is, active National Insurance number, UK or Irish passport or any of the documents listed on the gov.uk website - Right to work checks: an employer's guide projects should request either:

    • a letter, from the Home Office, confirming that the participant has been successful in an application under the EU Settlement Scheme or
    • evidence that the participant has been granted a visa under the UK’s points-based immigration system.

    Participants can prove their right to work on an online app - ID Check app or they will have a biometric residence permit which allows them to use the online Right to Work service to prove their right to work in the UK.
